You indicate acceptance of these terms and conditions of
service by placing an order with Arab British Host. These terms and
conditions will not be varied for individual customers.
1 DUTIES
1.1 Arab British Host will provide to the Customer the Services specified in
their order subject to the following terms and conditions.
1.2 The Customers have to backup their website data and it is their
responsibility to keep the data in case of any failure in some parts of the
server. Arab British Host may not provide backup for customers because it
takes time and a lot of CPU resources thus crush the server.
2 CHARGES, PAYMENT AND MONEY-BACK GUARANTEE
2.1 Payment methods include
bank transfers, credit cards (including
MasterCard, American Express,
Discover and Visa), debit cards (including
Maestro (Switch), Solo and Visa
Delta).
2.2 Arab British Host do not accept cheques, postal orders,
cash or any other form of payment other than those above.
2.3 The Charges are exclusive of VAT, which if payable will be paid by the
Customer.
2.4 Arab British Host provide "Money-Back Guarantees" on certain products
within 30 days of placing your order for a full refund. This guarantee
excludes domain names which may not be cancelled once ordered and excludes
any costs paid using bank transfer. Customers are
limited to using the money-back guarantee once.
2.5 All services will renew until cancelled by the customer. Arab British
Host emails the customers primary email address prior to renewal of
services, it is the customers responsibility to cancel services prior to
renewal as no refund can be made once renewal has occurred. Customers must
notify us at least 72 hours before a service is renewed if they wish to
cancel that service. The cancellation process must be fully completed by you
before your account is cancelled.
3 SERVICE LEVELS AND DATA BACKUP
3.1 Arab British Host will use its reasonable endeavours to make the server
and the Services available to the Customer 100% of the time but because the
Services are provided by means of computer and telecommunications systems,
Arab British Host makes no warranties or representations that the Service
will be uninterrupted or error-free and Arab British Host will not, in any
event, be liable for interruptions of Service or downtime of the server.
3.2 Arab British Host carries out data backups for use by Arab British Host
in the event of systems failure. Arab British Host do not provide data
restoration facilities for individual customers. Even though every effort is
made to ensure data is backed up correctly. Arab British Host is not
responsible for data loss or corruption.
4 ACCEPTABLE USE POLICY
4.1 The website and use of the Services may be used for lawful purposes only
and the Customer may not submit, publish or display any content that
breaches any law, statute or regulation. In particular the Customer agrees
not to:
4.1.1 use the Services or the website in any way to
send unsolicited commercial email or "spam", or any similar abuse of the
Services;
4.1.2 send email or any type of electronic message with
the intention of affecting the performance of any computer facilities;
4.1.3 publish, post, distribute or disseminate
defamatory, obscene, indecent or other unlawful material or information, or
any material or information which infringes any intellectual property rights
(for the avoidance of doubt this includes licensed software distributed as
Warez), via the Services or on the Website;
4.1.4 threaten, abuse, disrupt or otherwise violate the
rights (including rights of privacy and publicity) of others;
4.1.5 engage in illegal or unlawful activities through
the Services or via the Website;
4.1.6 make available or upload files to the website or
to the Services that the Customer knows contain a virus, worm, trojan or
corrupt data; or obtain or attempt to obtain access, through whatever means,
to areas of Arab British Host's network or the Services which are identified
as restricted or confidential. This includes leaving your home directory
whilst using SSH access to servers.
4.1.7 operate or attempt to operate IRC bots or other
permanent server processes.
4.2 The Customer has full responsibility for the content of the Website.
Arab British Host is not obliged to monitor, and will have no liability for,
the content of any communications transmitted by virtue of the Services.
4.3 If the Customer fails to comply with the Acceptable Use Policy outlined
in Clause (4.1) Arab British Host will be entitled to withdraw the Services
and terminate the Customer's account without notice.
5 DATA TRANSFER
5.1 Web hosting accounts include a certain amount of data transfer, if you
exceed this amount in any one month your account will be deactivated until
you have upgraded to an account that has more data transfer included.
5.2 Web hosting accounts that host file distribution such as videos, music
and software are limited to a maximum data transfer of 25 GB per month for
file distribution.
5.3 Web hosting accounts are prohibited from hosting adult content
orientated websites, hosting banners, graphics or cgi scripts for other
websites, storing pages, files or data as a repository for other websites or
personal computers, giving away web space under a domain, sub domain or
directory.
6 WEBSPACE USAGE
Large web space is available for genuine web site content, content must be
linked into web pages. Customers are prohibited from using the server as a
file/backup repository.
7 MAIL BOXES
Mail boxes not accessed for 100 days or more will be deleted from the
system.
8 ENTIRE AGREEMENT
The agreement can be updated without notifying the customers.
9 DOMAIN NAME REGISTRATION
9.1 Domain names are not deemed to be successfully registered until they
appear in the relevant WHOIS database of the top level domain name
registrar. In the event that a domain name is unavailable when we attempt to
register it Arab British Host will provide a full refund for that domain
name, this will be the full limit of our liability.
9.2 Arab British Host will make reasonable endeavors to renew domains where
the renewal fee has been paid. In the event that we are unable to renew a
domain name and that domain name is subsequently lost, the limit of our
liability will be the renewal fee for that domain name.
10 PROGRAMMING & SCRIPTING
Arab British Host are not responsible for customer programming issues other
than ensuring that programming languages such as Perl, PHP and ASP are
installed and functioning on the web hosting system.
11 PRIVACY
To protect your privacy we will not distribute your details to third
parties, unless required to do so by law.
12 INDEMNITY
The Customer agrees to indemnify and hold Arab British Host and its
employees and agents harmless from and against all liabilities, legal fees,
damages, losses, costs and other expenses in relation to any claims or
actions brought against Arab British Host arising out of any breach by the
Customer of the terms of this Agreement or other liabilities arising out of
or relating to the Website.
13 TERM AND TERMINATION
13.1 This Agreement will become effective on the date the service is ordered
and will continue until terminated by either party in writing of its
intention to terminate the Agreement.
13.2 Arab British Host will have the right to terminate this Agreement with
immediate effect by notice in writing to the Customer if the Customer fails
to make any payment when it becomes due.
13.3 On termination all data held in the customers account will be deleted.
14 DEACTIVATED ACCOUNTS
When a web hosting account is deactivated, you agree that after 50 days this
account may be deleted from the system without notice.
15 Types of websites which are not allowed to use our
services:
15.1 Adult content-orientated websites.
15.2 File distribution websites e.g. a website distributing large movies,
software or MP3s.
15.3 Hosting banners, graphics or cgi scripts for other websites.
15.4 Storing pages, files or data as a repository for other websites.
15.5 Reselling or giving away web space under a domain, sub domain or
directory.
15.6 Websites calling for terrorism.

إن طلبك لأحد خدمات الشبكة
العربية البريطانية للاستضافة (AR-H) يدل على موافقتك على شروط و اتفاقيات
الخدمة. هذه الشروط و الاتفاقيات لن تختلف لعميل أو لآخر.
1 الواجبات
1,1 الشبكة العربية البريطانية للاستضافة (AR-H) سوف تزود العميل بالخدمات
المحددة في عنوان طلبهم حسب الآتي من الشروط و الاتفاقيات.
1,2 إن على العملاء أن يعملوا نسخ احتياطية لبيانات مواقعهم و إنها لمسؤوليتهم
في الحفاظ على البيانات في حال حدوث خلل مفاجأ في بعض الأماكن على السيرفر.
الشبكة العربية البريطانية للاستضافة (AR-H) يمكنها أن لن توفر نسخ احتياطية
للعملاء لأن ذلك يأخذ الكثير من الوقت و الكثير من مصادر المعالج المركزي (CPU)
مما يسبب ضعف و تخريب لسيرفر.
2 شروط التكلفة و الدفع و ضمان إعادة المبلغ المدفوع
2,1 طرق الدفع تتضمن التحويل البنكي و بطاقات الاعتماد (credit cards) مثل ماستر كارد و فيزا و
أمريكان إكسيرس و ديسكفري كما
تتضمن بطاقات الائتمان (debit cards) مثل ماسترو (سويتش) و صولو و فيزا
و فيزا دلتا.
2,2 الشبكة العربية البريطانية للاستضافة (AR-H) لا تقبل شيكات
و لا حوالة بريدية و لا نقد و لا أي طريقة أخرى غير المذكور في الأعلى.
2,3 تكلفة الخدمة لا تتضمن ضريبة القيمة المضافة (VAT) المعتمدة في بعض الدول
الأوروبية فإذا كان يتوجب على العميل دفع ثمن هذه الضريبة لتواجده في إحدى هذه
الدول فالدفع يجب أن يتم من قبله إضافة إلى ثمن الخدمة.
2,4 الشبكة العربية البريطانية للاستضافة (AR-H) تضمن لمن لم تعجبه خدمة
الاستضافة لدينا بطلب إعادة المبلغ المدفوع إذا تم الإبلاغ خلال الـ30 اليوم
الأولى فقط منذ طلب الخدمة.
يسمح للعميل الذي ألغى اشتراكه أن يشترك مرة ثانية ولكن لا يسمح بإعادة المبلغ
إليه إذا قرر الانسحاب ثانيتاً و لا ينطبع عليه شرط إعادة المبلغ.
هذا الضمان لا يتضمن أسماء النطاق (domain names) التي لا يمكن أن يلغى تسجيلها
بعد تمامه و لا يرد ثمنها كما لا يتضمن المبالغ التي دفعت
باستخدام التحويل البنكي.
2,5 كل الخدمات قابلة للتجديد إذا رغب العميل استمرارها بعد انتهاء الاشتراك
السابق و في هذه الحالة عليه دفع ثمن الخدمة عند التجديد و سوف تقوم الشبكة
العربية البريطانية للاستضافة (AR-H) بإرسال للعميل رسائل مسبقة لتبليغه عن
تجديد الخدمة.
على العملاء الراغبين بعدم تجديد اشتراكهم و استمرارهم في الخدمة إبلاغنا قبل
انتهاء الاشتراك بـ72 ساعة لكي تتمكن الشبكة العربية البريطانية للاستضافة
(AR-H) من إنهاء الاشتراك في الوقت المحدد.
3 مستوى الخدمة و تخزين النسخ الاحتياطية للبيانات
3,1 الشبكة العربية البريطانية للاستضافة (AR-H) سوف تسعى على جعل السيرفر و
الخدمات متوفر للعملاء بنسبة 100% و لكن بسبب أن الخدمات المقدمة تتم عن طريق
استخدام أجهزة الحاسوب و أنظمة الاتصال عن بعد فإن الشبكة العربية البريطانية
للاستضافة (AR-H) لا تضمن أن الخدمة سوف تكون مستمرة و خالية من الأخطاء و إن
الشبكة العربية البريطانية للاستضافة (AR-H) سوف لن تكون مسؤولة عن أي تقطع في
الخدمة أو توقف السيرفر عن العمل لفترة مؤقته.
3,2 الشبكة العربية البريطانية للاستضافة (AR-H) تقوم بتخزين البيانات فقط
لاستخدامها الخاص في حال حدوث إخفاق في النظام و لكن الشبكة لا تقدم خدمة إعادة
إصلاح البيانات للعملاء حتى لو أن كل الجهود تعمل لتأكد من أن النسخ كان
صحيحاً, لذلك فإنّ الشبكة العربية البريطانية للاستضافة (AR-H) ليست مسؤولة عن
ضياع أو خراب البيانات لذلك يجب على العميل بالحفاظ على نسخ احتياطية من بيانات
و ملفات الموقع ليمكنه من استرجاعها في حال حدوث أي خلل بالسيرفر.
4 سياسة الاستخدام المقبول
4,1 إن الموقع و الخدمات يمكنها أن تستخدم فقط لأهداف شرعية و قانونية و يجب
على العميل أن لا يرسل أو ينشر أو يعرض أي محتوى يخترق أي القانون أو نظام أو
تنظيم, و على وجه الخصوص فإن العميل يوافق على:
4,1,1 أن لن يستخدم الخدمات أو الموقع بأي طريقة لإرسال
رسائل تجارية غير مطلوبة أو رسائل مزعجة أو أن يسيء استخدام الخدمة بطريقة
مشابهة.
4,1,2 أن لن يرسل رسائل بريدية أو أي صنف من الرسائل
الالكترونية بغاية التأثير على طريقة أداء أي جهاز حاسوب.
4,1,3 أن لن ينشر أو يوزع أو يرسل معلومات أو مواد غير
شرعية لغرض تشويه سمعة الآخرين أو أن تكون فاحشة و غير محتشمة أو أن تسبب تعدي
حقوق الملكية الشخصية (مثل توزيع برامج غير مرخصة) بواسطة الخدمات أو على
الموقع.
4,1,4 أن لن يهدد أو يسيء استخدام أو يعطل أو يخترق حقوق
الآخرين كحقوق الخصوصية.
4,1,5 أن لن ينخرط بنشاطات غبر قانونية و غير شرعية
بواسطة الخدمات أو الموقع.
4,1,6 أن لن يعمل بتوفير أو بتحميل ملفات إلى الموقع
بالعلم من أنها تحتوي على فيروسات أو برامج مخربه للبيانات كما يجب أن لا يحاول
الدخول بأي طريقة إلى أماكن تخص الشبكة العربية البريطانية للاستضافة أو إلى
خدمات التي قد حدد أنها محظورة أو سرية.
4,1,7 أن لن يدير أو محاولة إدارة برنامج الدردشة (IRC
bots) أو أي عمليات سيرفر دائمة أخرى.
4,2 إن على العملاء المسؤولية كاملة بما تحتويه مواقعهم و إنه ليس واجباً على
الشبكة العربية البريطانية للاستضافة أن تراقب محتويات المواقع المستضافة لديها
كما أنها ليست مسؤولةً عن ما تحتويه المواقع المستضافة.
4,3 إذا فشل العميل في مراعاة سياسة الاستخدام المقبول فإن الشبكة العربية
البريطانية للاستضافة (AR-H) مخولة بسحب الخدمات و إنهاء حساب العميل بدون
تبليغ مسبق و بدون إعادة المبلغ المدفوع.
5 مرور البيانات
5,1 إن حسابات استضافة المواقع تحتوي على كمية محددة لتمرير البيانات لكل شهر
فإذا تم تجاوز هذه الكمية في أي شهر فإنّ الحساب سوف يلغى تفعيله حتى يتم ترقية
الحساب إلى حساب يحتوي على كمية أكبر لتمرير البيانات أو حتى يأتي الشهر الذي
يليه.
5,2 إنّ حسابات استضافة المواقع التي تستضيف ملفات للتوزيع مثل الأفلام و
الأغاني و البرامج يسمح لها كحد أقصى بـ 25GB/شهر لتوزيع هذه الملفات.
5,3 إنّ حسابات استضافة المواقع ممنوعة من استضافة مواقع مخلة للآداب أو
استضافة شعارات (banners) أو صور أو سكربتات لمواقع أخرى كما أنها ممنوعة من
تحزين صفحات أو ملفات أو بيانات كمخزن لمواقع أخرى و ممنوعة أيضاً من أن تهب أو
تبيع مساحة تخزينية تحت اسم نطاق أو اسم فرعي لأشخاص آخرين.
6 استخدام مساحة التخزين
تقدم الشبكة العربية البريطانية للاستضافة (AR-H) مساحة كبير لتخزين البيانات
الخاصة بالموقع لاستخدامها يشترط أن تكون كل البيانات المخزونة فيها مربوطة
لصفحات الموقع المستضاف و لا يسمح باستخدام مساحة التخزين في السيرفر بغرض خزن
بيانات و نسخ احتياطية فقط دون أن تكون مربوطة بالموقع.
7 الصناديق البريدية
إن الصناديق البريدية (Mail Boxes) التي لم تستخدم أو يتم الدخول إليها من قبل
العميل الخاصة بالموقع لأكثر من 100 يوم سوف تحذف من النظام بشكل أوتوماتيكي.
8 إن كل الشروط و الاتفاقيات يمكن أن تحدث بدون موافقة مسبقة من
العملاء.
9 تسجيل أسماء النطاق
9,1 إن اسم النطاق لن يعتبر أنه قد سجل بنجاح حتى يظهر في بيانات WHOIS و في
حال أن اسم النطاق غير متوفر عندما نحاول تسجيله فإنّه يترتب على الشبكة
العربية البريطانية للاستضافة (AR-H) بتزويد العميل بثمن اسم النطاق المدفوع من
قبل العميل و إنّ هذا الإجراء هو المسؤولية الوحيدة التي تترتب على الشبكة.
9,2 إنّ الشبكة العربية البريطانية للاستضافة (AR-H) سوف تسعى لتجديد أسماء
النطاق عندما يتم دفع ثمن التجديد و في حالة عدم قدرتنا على تجديد اسم النطاق
بسبب ضياعه أو تأخر العميل في تجديده فإن مسؤوليتنا هي فقط إعادة ثمن التجديد.
10 البرمجة و السكربتات
إنّ الشبكة العربية البريطانية للاستضافة (AR-H) ليست مسؤولة عن مسائل و شؤون
البرمجة الخاصة بالعملاء ولكن علينا فقط أن نكفل أنّ لغات البرمجة مثل Perl و
PHP و ASP منزلة و تعمل على نظام استضافة المواقع.
11 الخصوصية
لحماية خصوصية العملاء فإننا لن نقوم بنشر أي معلومات تخص العملاء لجهة ثالثة
ما لم تطلب بشكل أو بأمر قانوني أو قضائي.
12 التعويض
إن العميل يوافق بتعويض الشبكة العربية البريطانية للاستضافة (AR-H) لأي ضرر أو
خسارة أو مدفوعات قانونية أو أي نفقة فيما يتعلق بشأن أي ادعاء أو دعوى قانونية
ضد الشبكة العربية البريطانية للاستضافة (AR-H) التي نشأت عن خرق العميل للشروط
في هذه الاتفاقية أو لمسؤوليات أخرى.
13 مدة و طريقة إنهاء الاتفاقية
13,1 إنّ هذه الاتفاقية تصبح سارية المفعول من تاريخ يوم طلب الخدمة حتى
انتهاءها بواسطة إحدى الطرفين بكتابة رسالة عن نية الطرف بإنهاء الاتفاقية.
13,2 إنّ الشبكة العربية البريطانية للاستضافة (AR-H) لديها الحق في أن تنهي
هذه الاتفاقية بعد إبلاغ العميل إذا العميل فشل في دفع المستحقات عندما يحين
وقتها.
13,3 عند إنهاء الاتفاقية و الخدمة فإنّ كل البيانات المخزونة في حساب العميل
سوف تحذف جميعها.
14 الحسابات الغير مفعلة
عندما يتم إلغاء تفعيل حساب استضافة الموقع لسبب ما فإنّ العميل يوافق على أنّ
الحساب يمكن أن يحذف من النظام بدون تبلغ بعد 50 يوماً من تاريخ إلغاء تفعيل
ذلك الحساب.
15 أصناف المواقع التي غير مسموح لها باستخدام خدماتنا:
15.1 مواقع مخلة للآداب.
15.2 مواقع متخصص بتوزيع الملفات كموقع ينشر أفلام كبيرة الحجم أو برامج أو
صوتيات
15.3 مواقع تستضيف شعارات أو صور أو سكربتات لمواقع أخرى.
15.4 مواقع تخزن صفحات أو ملفات أو بيانات لمواقع أخرى و تكون كمستودع تخزين
لها.
15.5 مواقع تعيد بيع أو إعطاء مساحة تخزينية تحت اسم نطاق أو اسم نطاق فرعي
لمواقع أخرى.
15.6 مواقع تدعوا للإرهاب. |
